EPA's New Regulated Waste Definition Under RCRA

On October 7, 2008, the Environmental Protection Agency issued a new final rule that streamlines regulation of hazardous secondary materials to encourage beneficial recycling and help conserve resources. By removing unnecessary regulatory controls, EPA expected to make it easier and more cost-effective to safely recycle hazardous secondary material. The Sierra Club filed a petition with the administrator of the EPA requesting that the EPA reconsider and repeal all or part of the rule. This reference set will cover the history of the rule, explain its terms, and discuss the prospect for its implementation. These reference materials will educate generators of waste, and consultants and counsel who advise generators, about what materials that have generally been considered hazardous waste will no loner be regulated as hazardous waste. Familiarity with the new regulatory structure could result in significant savings of money, time and resources to hazardous waste generators.
